Can you send a screenshot of the error?
Since it’s not working in batch, but works when you run it, you probably just need to add this one step. Does the first step select that specific layer to convert to smart object? If not, select a different layer, hit record, then select the desired layer as the first step of you action. let me know if that fixes it
